This Privacy Notice (“Notice”) explains  how TransUnion Telematics Services LLC (“Driver Score”) (“we,” “us,” or “our”)  handles personal information and outlines your rights. Use of our services constitutes your agreement to the terms of this Notice. If you do not agree with the terms of this Notice, please do not use our services.

Scope: This Notice applies to the extent we act as a data controller with respect to the services and products we provide via the Driver Score  websites, applications, products, features, application program interfaces, and related applications. This Notice applies to TransUnion® Drive (including the TransUnion Driver Score and TruVision Driver Score), but does not cover practices of other TransUnion businesses or products,  nor your interactions with us as a job applicant. Please see those respective privacy notices listed on the left-hand panel of this page for more information on those privacy practices.

For transparency purposes only, this Notice provides information about your rights with respect to certain consumer credit reporting and other regulatory activities governed by the Fair Credit Reporting Act. This information is available in the “Rights under the Fair Credit Reporting Act (FCRA)” section below. Otherwise, this Notice does not apply to entities, services, or products that fall outside the scope of comprehensive U.S. state privacy laws, including services governed by the Driver’s Privacy Protection Act (DPPA), the Health Insurance Portability and Accountability Act (HIPAA), the Gramm‑Leach‑Bliley Act (GLBA), and state insurance laws. In those cases, the applicable notices and rights provided under those laws apply, rather than the disclosures and rights in this Notice.

Notice at Collection: We collect personal information as described in this Notice. The categories of personal information that we collect are listed below under “Collection and use of personal information,” which also describes the purposes for which we collect and use personal information. It is likely you authorize your wireless operator to disclose your mobile number, name, address, email, network status, customer type, customer role, billing type, mobile device identifiers (IMSI and IMEI) and other subscriber status and device details, if available, to our third-party service provider, solely to verify your identity and prevent fraud for the duration of the business relationship. TUI limits the use of this information to prevent fraud and unauthorized access or disclosures of your personal information.

  • Information about your interactions with the app or website, for example, when you view or search content, we receive and track that information; web or app session; log file information; information such as the website(s) or app(s) you visited, when you visited the website, how long you stayed, your behavior while you were on our services and from what device you accessed the service; device identification information which we may associate with a mobile telephone number you provide used to access the service; email address, first and last name, the IP address and information related to that IP address, the internet service provider or proxy used, operating system information, browser information (the pages you view, how long you stay on each page, how often you come back and your behavior while you are on our service); and which advertisement, emails, SMS notifications or other push notifications related to the website and/or Product, offer or online content you view, access, or click on, including to get to the Online Services or while you are on the services

Under the definitions and exceptions of the Connecticut Data Privacy Act, we do not use your personal data to train large language models in our services where we act as a controller. You may consent to have your personal data shared with a third party, who may use personal data to customize a large language model (for example, if you enable a data connection to your AI agent). When we sell personal data to our customers, they may use that data to customize large language models for internal purposes or as necessary to provide their products and services.

In addition to the disclosures described above, we may disclose personal information to comply with legal requirements, respond to government requests, support investigations or legal proceedings, protect rights and safety of us, you, or other individuals, prevent fraud and other unlawful activity, and as otherwise permitted or required by law. This may include, for example, disclosing information to emergency services in the event of a car crash or safety incident. We may also disclose personal information to government authorities, regulators, law enforcement, courts, parties involved in legal proceedings, and our professional advisors and service providers, such as attorneys, accountants, consultants, and agents, subject to appropriate confidentiality and security safeguards.

4. Managing your account and authorizations

Managing your account. You are responsible for maintaining the accuracy of the information that you provide to us and for your own password management and online safety when accessing our products. Please always consider best practices like changing your password routinely, using a strong password that is not the same as you use for other websites or apps, and not accessing our products with unsecure devices or unsecure networks.

  • Your account for TransUnion Interactive may be used as your Driver Score login, including any personal information associated with that account.
  • You may make changes to your account settings through the settings of that service, such as modifying your email address, phone number, mailing address, payment card information, and password details. You may also cancel your account online, if applicable, and manage communications preferences related to certain types of communications (email and SMS/MMS) from us to you.
  • Please note that although you may manage communication preferences so that you do not receive commercial communications from us outside of our product dashboard, you may not decline to receive transactional communications from us, which contain information about your account and products. Please also note that important information about your account, including the alerts that are a part of our products, will be sent to the email address and/or phone number that you have provided, if applicable. It therefore is important that you update your account information when necessary and actively check email communications from us.

Authorizations for Driver Score. You enroll for Driver Score by creating a TransUnion Interactive or Driver Score account and providing written instruction and authorization for Driver Score to obtain your driving and insurance-related information as well as to use and share the information provided by you, along with your credit information, to obtain personalized offers from third parties and display personalized offers to you. If you delete the Driver Score app and disable connections to your vehicle’s tracking (where applicable), the app will no longer be able to access your precise geolocation, motion tracking, and similar tracking information. You may also adjust those tracking options through your phone’s permissions for that app. Please note that disabling such features will also disable any safety features dependent on that data, such as crash detection. If you no longer wish to participate, you may cancel your account at any time. If your account is still active, we may need to keep some personal information to provide our services. To have all eligible personal information deleted, please cancel your account first.

Surveys. From time-to-time, you may be presented with a survey or other questions to solicit feedback about your use of our products and services. Your participation in these types of market research activities is optional. Should you choose to participate, we may use information you provide to improve and/or develop our products and services.

Personalized (third-party) offers. In order to provide you with an optimal consumer experience, we strive to continually personalize the products, including the offers displayed on the product dashboard and delivered to you by email for some services. We want you to have access to personalized offers based on individual experience, and not generic offers that may or may not be suited to an individual user’s needs.

  • Personalized offers, including prescreen offers, are third-party offers displayed automatically on the app, via email, and in addition to other display locations as part of our product offering. Permission to use your credit information to show you personalized offers on the product dashboard was provided by you during the enrollment process. For Driver Score, you may opt out of receiving in-app personalized offers by using the settings of the app. 
  • We may share personal information with affiliates and commercial partners or service providers so that the personalized offers can be generated by the third party and then displayed to you. For example, to enable the delivery of a personalized offer from a lender (itself or through an aggregator of loan offers), the lender must have access to your personal information to extend an appropriate offer for which you may be eligible. The lender may separately access your credit information if it has a lawful purpose to do so.
  • You may enroll in personalized offers through a third party and enable them to access Driver Score information to enable those services.
  • In addition to seeing personalized offers on the product dashboard, you may receive personalized offers via email or other forms of communication from us. You have the choice to opt out of our marketing email communications at any time by using the opt-out provision/unsubscribe link at the bottom of every marketing email.
     

5. Privacy rights and choices

When we act as a data controller, you may have certain privacy rights under applicable US state privacy laws. These may include the right to access, correct, or delete your personal information. You may also have the right to appeal if we deny your request.

To exercise your US state privacy rights (subject to applicable legal limits and exceptions), visit our US State Privacy Rights page to submit a request. We may request your name, address, email, phone number, date of birth, and either your full Social Security number or the last four digits to locate your records. For certain requests, we require you to answer some security questions to verify your identity. If we provide your information electronically, we will do so in a portable format. When technically possible, we will provide it in a format that is easy to use and transfer to another entity.

  • Because we may “sell” or “share” personal information or engage in “profiling,” “targeted advertising,” “cross-context behavioral advertising,” or use sensitive personal information, consistent with the defined terms in applicable state laws, you may also exercise your opt-out rights from such sales/sharing, profiling/automated decision making, targeted advertising, or cross-context behavioral advertising, and limit our use of your sensitive personal information.

In some instances, we offer our services to customers as a service provider/data processor or are subject to other exceptions under the applicable state privacy laws. Where we are acting as a service provider/data processor, we are processing data on behalf of others who will provide you with applicable privacy rights.

The US State Privacy Rights and Submit an Opt-Out / Limitation Request rights pages apply to the US services covered in the notices for Transunion LLC, TUI, TURSS, TRADS, Neustar, Driver Score, and Marketing Solutions. If you use a consumer right using these links, you do not need to request those consumer rights again for the other covered services.

Explanation of Privacy Rights and Choices

In the US, residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia have some or all of the below privacy rights. We may offer these rights to other jurisdictions where required by law or at our discretion.

  • Right to Access/Know. You may have the right to request a privacy report detailing the personal information collected, disclosed, sold, and shared about you and the purpose for doing so, unless such request proves impossible or would involve disproportionate effort.
  • Right to Correct. You may have the right to correct inaccurate personal information that we collect or maintain about you, subject to verification.
  • Right to Delete. If we collected or maintain personal information about you, you may have the right to request the deletion of this personal information, unless an exception applies under applicable law.
  • Right to Opt Out of Sale/Sharing. You may have the right to opt out of the sale/sharing of your personal information to third parties.
  • Right to Opt Out of Profiling/Automated Decision Making, Targeted Advertising, or Cross-Context Behavioral Advertising. You may have the right to opt out of our use of your personal information for purposes of profiling, automated decision making, targeted advertising, or cross-context behavioral advertising.
  • Right to Limit the Use of Sensitive Personal Information. You may have the right to limit how we use your sensitive personal information. Depending on the applicable law, sensitive personal information may include: Social Security number, driver’s license number, biometric information, precise geolocation data, and racial and ethnic origin.
  • Right to Request Specific list of Third Parties. You may have the right to request a list of the specific third parties with whom we have disclosed personal information.
  • Right to Appeal. If you believe we have denied any of your US state privacy rights in error, you may have the right to appeal by replying to our denial message or any communication from us.

These rights are subject to limitations and exceptions under applicable privacy laws. They may vary by region, and the functionality and features available on our services are subject to change. We do not discriminate against you based on your exercise of your privacy rights.

6. Privacy rights via authorized agent

A. Opt-Out Requests and Requests to Limit Use of Sensitive Personal Information

For an authorized agent (with or without power of attorney) to submit an opt-out request or a request to limit the use of a consumer’s sensitive personal information on behalf of a consumer, the authorized agent is required to submit the following: 

  • Written authorization signed by the consumer, clearly permitting the agent to act on their behalf, 
  • The agent’s name must match the name listed in the authorization, 
  • Consumer identification details, including: First and last name (middle name optional), Residential address (including unit number, city, state, and ZIP code), and 
  • (Optional but strongly recommended to find relevant records) Social Security number and Date of birth. 

B. Verifiable Requests (Access, Correction, Deletion) 

For an authorized agent to submit a verifiable privacy request with a valid power of attorney, the agent must provide:

  • A valid power of attorney executed in accordance with applicable law
  • Sufficient information to allow us to locate the consumer’s file

For an authorized agent to submit a verifiable privacy request without a power of attorney, the authorized agent must provide one item from each of the following two categories:

  1. Consumer Authorization
    • Signed permission from the consumer authorizing the agent to submit the request
    • The agent’s name must match the name on the authorization
    • The authorization must describe the type(s) of request (e.g., access, correction, deletion)
       
  2. Consumer Identity Verification The consumer must verify their identity directly with us by submitting sufficient proof of identification, such as:
    • Social Security number or a copy of a Social Security card
    • Certified or official copy of a birth certificate
    • Valid driver’s license or other government-issued identification

The identification provided must match the name in the authorization and the submission must include sufficient information for us to locate the consumer’s file. The authorized agent may review the types of information we require by looking at information requested on the US State Privacy Rights page.

7. Rights under the Fair Credit Reporting Act (FCRA)

8. Personal information of children

Our services are not intended for use by nor directed to individuals under the age of eighteen (18). You must be at least eighteen (18) to access our services and products or become a member of any membership program entitled to membership benefits. If we learn that we have collected or received personal information from individuals under the age of eighteen (18), we will delete the personal information or otherwise comply with applicable law. We do not knowingly sell the personal information of children under the age of eighteen (18).

 

9. Securing personal information

We maintain a comprehensive information security program with administrative (policies, standards, and processes), physical, and technical controls designed to protect the confidentiality, integrity, and accessibility of personal information.

 

10. Retaining personal information

We retain personal information for as long as necessary to fulfill the purposes for which it was collected or processed, as previously described in this Notice. For instance, we retain personal information, collected through our services and websites, for as long as a user’s account is active or as needed to provide services to our customers.

When determining retention periods, we consider our relationship with users and their information, the nature and sensitivity of the information, and what is reasonably necessary and proportionate to provide and improve our services. We also adjust retention periods to comply with our legal, reporting, or accounting obligations, to resolve disputes, and to enforce our agreements. We regularly review our retention periods and assess our data minimization practices, retaining the least amount of information for the shortest retention period, while still upholding all our obligations.

 

11. Corporate reorganization

In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, we may share your personal information. We may also share your personal information if we undergo bankruptcy or liquidation, in the course of such proceedings.
